LEE COUNTY, SC (WIS) - A day after being arrested, a Midlands man charged with sexually assaulting a child bonded out of jail.
Henry Magazine, 62, was released from the Sumter Lee Regional Detention Center Wednesday afternoon on a $40k surety bond.
Magazine was taken into custody by Lee County deputies Tuesday afternoon and charged with one count of criminal sexual conduct.
Deputies say an 11-year-old girl says Magazine sexually assaulted her at his home in November of 2010. We asked Magazine for a comment shortly before deputies took him away.
WIS News 10: Mr. Magazine, what do you have to say about the charges you're facing?
Magazine: Nothing to say, baby.
WIS: Are the charges true?
Magazine: No. It's not true.
WIS: Do you have anything to say to people that are going to see this story tonight?
Magazine: No and it doesn't need to be on the news to start with. It's wrong.
WIS: So you're saying that the Lee County Sheriff's Department is lying?
Magazine: I didn't say that. I didn't say they're lying.
WIS: You said the charges aren't true?
Magazine: It's not true. It's not true. I don't do things like that.
"I think the facts are disturbing," commented Lee County Sheriff's Major J. D. Dellinger, who says the case started November last year.
The girl, then 10 years old, went to the doctor with her mother for a routine check up. But Dellinger said what doctors found was anything but routine.
"We knew from the medical examination that absolutely something happened to her because of the medical findings," said Dellinger. "It was just a matter of continuing to work with her and allowing that to come out in a safe environment."
Dellinger says investigators didn't know if the case was criminal, but they moved the girl from her home as a precaution. "All minor children that are involved in abuse cases we refer to an outside agency," said Dellinger. "Sometimes it's the "Care House," to do what we call a follow up forensic interview."
Dellinger says two months after the assault, the girl admitted during a forensic interview that Henry Magazine sexually assaulted her at his Lee County home. "It's disturbing to think of a 60-year-old male with a 10-year-old female," said Dellinger. "It's just disturbing all the way around."
Henry Magazine was arrested and indicted in 1985 for the rape of a 14-year-old girl. Court records show the charge was reduced to contributing to the delinquency of a minor.
Dellinger says Magazine was given probation in that case. Now he has this advice for parents. "Develop a relationship with your child so that if something does happen that they're comfortable coming to you and talking to you," he said.
