Day 2 of Lowcountry tow truck operator murder trial begins

BEAUFORT CO., SC (WTOC) -

Court resumed Wednesday morning for day two of the Preston Oates trial. 

Oates is the tow truck operator charged with the 2010 murder of Carlos Olivera, of Bluffton. 

About a dozen witnesses were called to the stand on Tuesday, most of them were members of Olivera's family. 

The prosecution also played the 911 calls from that night, which brought Olivera's family to tears. 

Oates was trying to tow Olivera's car on Christmas Eve 2010 when the two got into an argument. Oates claims Olivera grabbed his gun so he got scared and that's why he shot him that night. However, Olivera's family says that is not true. 

Nelson Olivera, Carlos' brother, says Carlos never aimed his gun at Oates and that Oates continued to shoot Carlos, even after he fell face down. 

There were a total of 14 calls made to dispatch the night of the shooting. One of those calls came from Oates. 

Prosecutors say Oates shot Olivera six times. The defense maintains he did it in self defense.
