House speaker files response in attorney general's Supreme Court appeal

COLUMBIA, SC (WIS) -

House Speaker Bobby Harrell's legal team has filed its response against Attorney General Alan Wilson's state Supreme Court appeal of a circuit court decision ruling that stopped a State Grand Jury investigation against Harrell.

Last month, Judge Casey Manning ruled Wilson improperly empanelled a State Grand Jury in the case because courts cannot consider such a case against a lawmaker until a legislative ethics panel has reviewed it. Harrell's attorneys agree, but Wilson says the ruling infringes on his role as the state's top prosecutor.

In a statement, Harrell says Wilson's appeal of Manning's decision was a "political document designed to grab headlines" and failure to uphold the decision would "unleash the potential of a rogue prosecutor unrestrained by the Constitution and unaccountable to law and legal precedent." 

"My attorneys' response is a concise recitation of the law, legal precedents, and the Constitution," said Harrell.

In the meantime, a recent state Supreme Court ruling allowed Wilson to continue their investigation into ethics allegations against Harrell according to spokesperson Greg Foster.
