Attorney: Northport DUI suspect Danny Smith has died

TUSCALOOSA, AL (WBRC) -

A Tuscaloosa County man accused of two DUIs, including one wreck that killed a young girl in Northport in 2012, has died, according to his attorney.

Danny Ray Smith passed away Monday morning, his attorney Bob Prince said. Smith was arrested after the 2012 Tuscaloosa Air Show for allegedly killing 8-year-old Haylee Burk and injuring her mother and sister. He was charged with DUI, vehicular homicides, assault and leaving the scene of an accident.

He was released on bond for the 2012 DUI charge and arrested again for DUI in January. Smith missed his bond revocation hearing related to that charge because he was in the hospital.

In both cases of DUI, Prince said his client had not been drinking but believes his medical condition was the cause. His attorney has not released any information about Smith's medical condition.

In the second DUI arrest, Prince said Smith was having a "medical emergency" and wasn't under the influence when Northport police pulled him over on 32nd Street near Highway 82.

Smith was reportedly in a coma in January. His attorney said he had been in hospice care since last week.
