Prosecutors: Brett Parker was having an affair

The slow process to pick a jury for the case against admitted bookie Brett Parker began Tuesday afternoon, but not before prosecutors argued evidence of adultery should be admitted in court.

Selecting a jury for the Parker trial might be a little more difficult than normal. The case has gotten heavy news coverage and has been the subject of much speculation in the community over the past year.

Prosecutors say Parker carried out a calculated plan to kill his wife Tammy Jo and frame his business associate Bryan Capnerhurst for the murder before shooting him to death in the Parkers' $760,000 Ascot Estates home last April.

The solicitor's office says motives include insurance money and a couple hundred thousand dollars in Tammy Parker's 401k.

The state also says Brett Parker was having a sexual relationship with another woman and had even texted that woman with "romantic" messages an hour or two before Tammy was shot to death.

Prosecutors also said investigators found evidence Brett Parker had sex with his mistress in the home office for his gambling operation.

The issue of adultery and how potential jurors feel about it was one of the matters brought up Tuesday afternoon as Judge DeAndrea Benjamin opened a series of questions for more than 90 members of the jury panel.
