Ousted school board member appeals removal from board

Former Lexington-Richland School District 5 Board of Trustees member Kim Murphy has appealed the board's decision to remove her from the panel.

Based on court documents filed in the Court of Common Pleas, the appeal claims the school board has no authority to remove trustees holding Richland County seats. The appeal also claims that Murphy was elected and the previous ruling does not apply to elected trustees and the school board failed to follow specified administrative procedures.

The 11-page appeal was filed Thursday by Murphy's attorney, J. Todd Kincannon.

Earlier this month, the Board of Trustees voted 6-1 to remove Murphy from the board. The vote came after Judge Thomas Cooper recommended she be removed from the board.

Cooper said Murphy remaining on the board could open up "numerous potential negative legal problems for the district. 

The dispute has been over Murphy's residency.  A report by the Budget and Control Board said Murphy did not live in Richland County, which is the seat she represented on the board.
