Former Charlotte man's family suing government after missile attack death

CHARLOTTE, NC (WBTV) -

The family of a former Charlotte man is suing the U.S. government after he was killed during an air strike against a known terrorist in Yemen.

The lawsuit, from the American Civil Liberties Union on behalf of Khan's family, was filed in District Court in Washington, DC on Wednesday.

The family says they want answers in the death of their son.

Khan used to live in Charlotte and was the subject of several WBTV investigations for his connections to Al-Qaeda. He moved to Yemen and became the editor of an online magazine for Al-Qaeda.

Many people called Khan an terrorist.

Representative Sue Myrick said he was extremely dangerous, so much of a threat that he had moved up to be one of the top five operatives in the entire terrorist organization.

Khan and Muslim cleric Anwar-Al-Awaki died in a U.S. ordered drone attack in Yemen last year.
Al-Alwaki's family is also involved in the lawsuit, as are two civil rights groups. 

Both Khan and al-Alwaki were American, but left America to live in Yemen.

The lawsuit claims the attacks were in violation of their Constitutional rights.
