US criticizes ruling concerning American wanted by Iraq

(Washington-AP) February 9, 2007 - The Justice Department is unhappy that the US has been blocked from turning over an American to Iraqi justice.

A Justice Department spokesman says the ruling from a federal appeals court in the US will "inappropriately interfere with the executive branch's prerogative to prosecute a war."

The lawyer for the man, who was charged with supporting terrorists and insurgents in Iraq, disagrees. He says the ruling shows you can't throw someone in a legal black hole with no means to challenge.

The man, Shawqi Omar, was captured in Iraq by US forces in 2004, and has been held there ever since. His wife and daughter filed suit, demanding he be brought before a US court.

In an American court, prosecutors would have to show probable cause for holding him.
