High court to hear Friends of the Hunley foundation records case

(Columbia-AP) Oct. 30, 2005 - The state Supreme Court will hear arguments this week on whether South Carolina's open records law applies to the foundation set up to raise money for the Confederate submarine Hunley.

The sub sank in 1864 after becoming the first such vessel to sink an enemy ship during war.

The state set up a Hunley Commission and the Friends of the Hunley foundation to take care of the submarine and raise money for its restoration after it was raised from the ocean floor near Charleston in 2000.

Friends of the Hunley previously has said it does not have to comply with the state's Freedom of Information Act. Hunley Foundation lawyers argue the Supreme Court shouldn't hear the Freedom of Information Act issue because the group eventually gave retired Greenville businessman Edward Sloan the documents he first requested in 2001.

The lawyers now say they'll concede that the foundation has to comply with the Freedom of Information Act.
