Environmentalists begin case against MOX fuel at 3 Duke Energy plants

(Charlotte, North Carolina-AP) Dec. 4, 2003 - Environmentalists have officially begun presenting their case against Duke Energy's plans to test a blended plutonium fuel in its nuclear plants by 2005.

Duke Power eventually wants to use mixed-oxide fuel at its McGuire Nuclear Power Station near Huntersville, North Carolina, and the Catawba Nuclear Power Station near York.

The plants would be the first in the United States to burn the fuel, which would contain a small percentage of weapons-grade plutonium.

At a hearing in Charlotte's federal courthouse on Wednesday, attorney Diane Curran argued against the testing for her client, the Blue Ridge Environmental Defense League.

Duke Energy spokeswoman Rose Cummings says the company thinks it can use the fuel safely. The Nuclear Regulatory Commission's Atomic Safety and Licensing Board is not expected to rule until next month.
